O artigo examina algumas passagens centrais para o esclarecimento dos desafios colocados pelo pensamento da normatividade em Espinosa. Neste artigo, Jean-Marie Beyssade oferece algumas indicações preciosas sobre como a reflexão de Espinosa no campo teórico acerca da normatividade imanente à ideia verdadeira (“a verdade é norma de si mesma e do falso”) fornece elementos que permitem iluminar seu esforço para pensar também no campo prático uma concepção de normatividade imanente, concepção esta que seria compatível com sua crítica radical (...) à finalidade externa e sua recusa de qualquer modelo exterior que condena o ser em nome do dever ser. La palabra alemana Recht es difícil de traducir en algunas lenguas, como el inglés. Puede significar tanto “derecho(s)” subjetivo(s) como “ley” objetiva. La traducción habitual de Recht como “derecho” está ciertamente justificada, pero no debería implicar una comprensión de la teoría del espíritu objetivo de Hegel como una posición basada meramente en los derechos. Sugiero una lectura más matizada, en primer lugar, rastreando la historia filosófica de los conceptos “derecho subjetivo” y “derecho objetivo”. Un análisis cuantitativo del uso que hace (...) Hegel de la palabra Recht revela entonces cómo moviliza conscientemente toda la gama de sus significados. Por lo tanto, propongo un enfoque institucionalista de la filosofía de la ley y el derecho de Hegel: la palabra Recht es entonces un epítome metonímico de las instituciones legales, sociales y políticas. En estas instituciones se entrelazan normas objetivas, comportamientos y actitudes subjetivas. Sería contrario a toda la filosofía del espíritu objetivo de Hegel favorecer unilateralmente el punto de vista de los derechos sobre el de la ley (o los deberes); por lo tanto, esta teoría no es simplemente una “filosofía del derecho”. A teoria da justiça política de Hóffe, fundamentada na justiça comutativa, sustenta que a fundamentação de normas de sociedade, na comunidade discursiva, pela Ética do Discurso de Apel e Habermas, é apenas uma fundamentação derivada, posto que a comunidade discursiva — necessariamente pressupõe direitos humanos A Ética do Discurso afirma, por sua vez, que direitos humanos podem: ser legitimados somente através de discursos. Este artigo sustenta que a pressuposição normativa para ambas - a comunidade discursiva e o princípio de justiça (...) comutativa — é que todos cos seres humanos têm o direito de partilhar o mundo. Somente sob essa premissa da justiça distributiva, pode haver parceiros que exercem reciprocidade e participantes de discurso, que também têm algo sobre o que têm de decidir conjuntamente. (shrink)

El contexto de este artículo es la Francia posterior a mayo del 68. Arnaud se propone explicar las motivaciones que dan lugar al nacimiento de estructuras contestatarias dentro de las profesiones jurídicas en dicho país. Es decir, el autor explica cómo surge el movimiento de la “teoría crítica del derecho”. La judicatura más crítica considera que los problemas sociales son problemas políticos, y los sectores conservadores del poder judicial acusan a los sectores críticos de estar “politizados”. El sector contestatario de (...) la Academia denuncia la ideología formalista que elude las implicaciones sociales y económicas de las normas. Neste artigo considerarei as principais objeções marxistas ao modelo de Honneth para uma Teoria Crítica da sociedade e também as objeções centrais de Honneth aos modelos inspirados em Marx. Depois tentarei esboçar uma reaproximação entre ambas posições ao mostrar como o conceito normativo de reconhecimento de Honneth não é oposto a argumentos funcionalistas, e sim que ele contém uma dimensão socioteórica: a ideia de que a reprodução social e a evolução social revolvem ao redor de lutas pela interpretação de normas (...) sociais centrais. Ao iluminar o lado socioteórico do reconhecimento, é possível esboçar um modelo de Teoria Crítica da sociedade que, de fato, corresponda às características descritivas e normativa delineadas pelo próprio Marx. No entanto, o preço desta reaproximação para a Teoria Crítica de Honneth é uma ênfase maior na divisão do trabalho como o mecanismo central da reprodução social. (shrink)

Along with Husserl's Ideas and Heidegger's Being and Time, Being Given is one of the classic works of phenomenology in the twentieth century. Through readings of Kant, Husserl, Heidegger, Derrida, and twentieth-century French phenomenology (e.g., Merleau-Ponty, Levinas, and Henry), it ventures a bold and decisive reappraisal of phenomenology and its possibilities. Its author's most original work to date, the book pushes phenomenology to its limits in an attempt to redefine and recover the phenomenological ideal, which the author argues has never (...) been realized in any of the historical phenomenologies. Against Husserl's reduction to consciousness and Heidegger's reduction to Dasein, the author proposes a third reduction to givenness, wherein phenomena appear unconditionally and show themselves from themselves at their own initiative. A 62-year-old female with Huntington’s disease presented after a suicide attempt. Her advance directive stated that she did not want intubation or resuscitation, which her family acknowledged and supported. Despite these directives, she was resuscitated in the emergency department and continued to state that she would attempt suicide again. Her suicidality in the face of a chronic and advancing illness, and her prolonged consistency in her desire to take her own life, left careproviders wondering how to provide ethical, respectful care (...) to this patient. Tension between the ethical principles of autonomy and beneficence is central in this case. The patient’s narrative demonstrated that her suicide was an autonomous decision, free from coercion or disordered thinking from mental illness. Beneficence then would seem to necessitate care aligned with the patient’s desire to end her life, which created ethical uneasiness for her family and careproviders. The case highlights several end-of-life ethical considerations that have received much recent attention. With ongoing discussions about the legalization of aid in dying across the country, caregivers are challenged to understand what beneficence means in people with terminal illnesses who want a say in their death. This case also highlights the profound moral distress of families and careproviders that arises in such ethically challenging scenarios. (shrink)

In 2016, the Colorado legislature passed an amendment to Colorado’s medical proxy law that established a process for the appointment of a physician to act as proxy decision maker of last resort for an unrepresented patient (Colorado HB 16-1101: Medical Decisions For Unrepresented Patients). The legislative process brought together a diverse set of stakeholders, not all of whom supported the legislation. Following passage of the statutory amendment, the Colorado Collaborative for Unrepresented Patients (CCUP), a group of advocates responsible for initiating (...) the legislative process, coordinated a unique effort to engage these stakeholders in the creation of a set of voluntary guidelines to assist facilities and individual careproviders in the implementation of policies and procedures enabled by the statute. This article delineates the questions and concerns of stakeholders, describes how those issues were addressed within the guidelines, and proposes additional opportunities for research to assess the impact of the legislation in Colorado. La philosophie ne se réduit pas à la pure réflexion ni à la quête d'une sagesse intemporelle. Elle est aussi invention ou création de concepts. Elle s'expose volontiers à traverser le cours des sciences, à inscrire son histoire dans le contrepoint de leurs développements. Quand il se veut ainsi passeur de savoirs, le philosophe expérimente des concepts qui filtrent des interprétations, établissent des relations inattendues, modifient des approches trop abstraites : le temps, l'infini, la matière, le cosmos. L'enquête astrophysique ou (...) les recherches sur le cerveau offrent autant d'occasions de mises en perspective propices à la pédagogie que d'invitations à reconstituer le tissu des idées qui fondent la culture et les idéaux de nos sociétés. Même s'il analyse parfois des méthodes et des paradigmes scientifiques, ce livre ne relève pas de la philosophie des sciences telle que l'Université en définit la discipline. Il entend surtout questionner les conceptions scientifiques du monde qui justifient, transforment ou bouleversent nos croyances, nos comportements et aussi nos décisions. While discussions of dissolving the hyphen between Marxism and feminism were put on the back burner in the United States and England in the 1980s, the author argues that changes in Latin America during the same decade favor a possible convergence of contemporary Marxist and feminist theory and practice. These conditions include the emergence of a second-wave feminist movement in many Latin America countries, the central role of women in contemporary social movements, and an internal critique within Latin American Marxism. One of the strongest strands in Nancy's philosophy is an attempt to rethink community and the very idea of the social in a way that does not ground these ideas in some individual subject or subjectivity. The fundamental argument of this book is that being is always 'being with', that 'I' is not prior to 'we', that existence is essentially co-existence. He thinks this being together, not as a comfortable enclosure in a pre-existing group, but as a mutual abandonment and (...) exposure to each other, one that would preserve the 'I' and its freedom in a mode of imagining community as neither a 'society of spectacle' nor via some form of 'authenticity'. "Christian philosophy" is commonly regarded as an oxymoron, philosophy being thought incompatible with the assumptions and conclusions required by religious faith. According to this way of thinking, philosophy and theology must forever remain distinct. In From Theology to Theological Thinking, Jean-Yves Lacoste takes a different approach. Stepping back from contemporary philosophical concerns, Lacoste--a leading figure in the philosophy of religion--looks at the relationship between philosophy and theology from the standpoint of the history of ideas. He notes in particular that (...) theology and philosophy were not considered separate realms until the high Middle Ages, this distinction being a hallmark of the modern era that is coming to an end. Lacoste argues that the intellectual task before us now is to work in the frontier region between or beyond these domains, work he identifies as "the task of thinking." In this paper, we discuss the prevailing view amongst philosophers and many mathematicians concerning mathematical proof. Following Cellucci, we call the prevailing view the “axiomatic conception” of proof. The conception includes the ideas that: a proof is finite, it proceeds from axioms and it is the final word on the matter of the conclusion. This received view can be traced back to Frege, Hilbert and Gentzen, amongst others, and is prevalent in both mathematical text books and logic text books.

Drawing on an analysis of German national cybersecurity policy, this paper argues that cybersecurity has become a key site in which states mobilize science and technology to produce state power. Contributing to science and technology studies work on technoscience and statecraft, I develop the concepts of “territorialization projects” and “digital territory” to capture how the production of state power in the digital age increasingly relies on technoscientific expertise about information infrastructure, shifting tasks of government into the domain of computer scientists (...) and network engineers. The notion of territorialization projects describes states’ ongoing struggle to mobilize science and engineering in order to transform globally distributed information infrastructure into bounded national territory and invest it with patriotic meaning: making digital territory. Digital territory, in other words, is nationalized information infrastructure: it includes building and monopolizing infrastructure as well as normative ideas about nation—who is a digital citizen, and who isn’t; or what constitutes “good” and “bad” digital citizens. Nationalizing information infrastructure and placing statecraft into the hands of scientists and engineers might indicate an emerging form of “techno-nationalism”—a combination of nationalist and technocratic tendencies—raising urgent questions for STS scholarship to investigate the consequences of territorialization projects for justice, democracy, and civic life. This challenging and provocative book argues against much contemporary orthodoxy in philosophy and the social sciences by showing why objectivity in the domain of ethics is really no different from the objectivity of scientific knowledge. Many philosophers and social scientists have challenged the idea that we act for objectively authoritative reasons. Jean Hampton takes up the challenge by undermining two central assumptions of this contemporary orthodoxy: that one can understand instrumental reasons without appeal to objective authority, and that the (...) adoption of the scientific world view requires no such appeal. One of the key features of modern mathematics is the adoption of the abstract method. Our goal in this paper is to propose an explication of that method that is rooted in the history of the subject.

This paper consists of three main sections. In the first section, we consider how early attempts at understanding the relationship between mathematics and philosophy in Leibniz’s thought were often made within the framework of grand reconstructions guided by intellectual trends such as the search for “the ideal of system”. In the second section, we proceed to recount Leibniz’s first encounter with contemporary mathematics during his four years of study in Paris presenting some of the earliest mathematical successes which he made (...) there. In particular, we argue that recently published letters and papers reveal how his youthful mathematical reflexions were deeply intertwined with important philosophical insights that, in turn, acted as guiding ideas for his mathematical research. Finally, in the third section, we situate the central themes of the essays of the present volume within the new understanding of the interrelations between philosophy and mathematics in Leibniz’s thought briefly indicated in the opening section.
